Haritta Terms of Service
1.Acceptance of these terms
These Terms of Service ("Terms") are a legal agreement between you and Radix Software LLC, a limited liability company organized in the State of Wyoming, United States ("Haritta", "we", "us", or "our"). By creating an account or using the Haritta app or services (the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2.Eligibility
You must be at least 13 years old to use Haritta, and older where your local law requires (for example 16 in parts of the European Economic Area). By using the Service you confirm that you meet the applicable minimum age and are legally able to enter into these Terms.
3.Your account
You register with your mobile phone number, which we verify by sending a one-time code via SMS. You are responsible for the devices and phone number associated with your account and for activity that happens through your account. Keep your account secure and notify us promptly if you believe it has been compromised. You may not create an account for anyone else or transfer your account without our permission.
4.The service
Haritta lets you use maps, share your location, create and organize map content (such as spots, features, folders and posts), join and manage communities, discover contacts who use the app, and make voice and video calls with other users. We may add, change or remove features at any time. Some features require permissions (such as location, contacts, camera or notifications) that you can grant or revoke in your device settings.
5.Subscriptions and payments
Haritta offers a free tier and optional paid premium subscriptions, which may include a trial. Subscriptions are sold as in-app purchases through the Apple App Store or Google Play and are managed on our behalf by RevenueCat.
Payment is charged to your app store account at confirmation of purchase. Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. You manage and cancel your subscription in your Apple or Google account settings; deleting the app does not cancel a subscription.
Except as described in this section or where required by law or by the applicable app store's policy, payments are non-refundable. Refunds, where available, are handled by Apple or Google under their terms. Prices may change; we will give notice as required before a change affects you. If you are a consumer in a jurisdiction that grants a right of withdrawal for digital purchases, that right applies as provided by law.
If we temporarily suspend your account because you violated these Terms, your subscription is extended by the length of the suspension as far as the app store allows (at most 90 days on the App Store). If we close your account, you can ask for a full refund of your last payment in the app. On Google Play we stop your subscription from renewing and make the refund ourselves. On the App Store you need to cancel your subscription in your Apple account settings; Apple decides on the refund, and when Apple asks we tell it that we prefer the refund to be granted. When reviewing a refund request Apple may ask how much you used the app; we share that information with Apple through RevenueCat.
6.Your content
You keep ownership of the content you create in Haritta. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit and distribute your content solely to operate and provide the Service, including delivering it to the users and communities you choose to share it with. When you share content with others, you grant those users the rights needed to view and, where you permit it, organize that content within the Service.
You are responsible for your content and confirm you have the rights necessary to share it. We may remove content that violates these Terms or the law.
7.Acceptable use
You agree not to:
- break the law or infringe anyone's rights, including privacy and intellectual property rights;
- share content that is unlawful, harmful, harassing, hateful, deceptive, or that you have no right to share;
- track, surveil, harass or share the location of another person without their consent;
- upload phone numbers or contacts of people who have not consented, or misuse contact discovery;
- attempt to access accounts, data or systems you are not authorized to access, or interfere with, disrupt, reverse engineer or overload the Service;
- use bots or automated means to access the Service, or circumvent security, rate limits or device integrity checks;
- use the Service to spam, defraud, or distribute malware.
8.Communities and shared content
Communities and shared content are governed by the permissions set by their creators and by these Terms. Content you share may be seen, used and organized by other users according to the permissions you set. You are responsible for the communities you create and the content you contribute.
9.Location and contacts features
Location and contact features are optional and depend on permissions you grant. By enabling them you consent to the processing described in our Privacy Policy. Only share location and content with people you trust, and only enable contact discovery for address books you have the right to use.
10.Third-party services
The Service relies on third parties, including Apple, Google, RevenueCat, Twilio, Mapbox and a weather data provider. Your use of app store and device features is also subject to the terms of Apple or Google. We are not responsible for third-party services, and your dealings with them are governed by their own terms.
11.Intellectual property
The Haritta app, its name, logo, software and design are owned by us or our licensors and are protected by law. Except for the rights expressly granted to you to use the Service, we grant you no rights in our intellectual property. You may not copy, modify or create derivative works of the Service except as permitted by law.
12.Suspension and termination
You may stop using Haritta and delete your account at any time. We may suspend or terminate your access if you violate these Terms or the law, if required for security or legal reasons, or if we discontinue the Service. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability and governing law.
Decisions to suspend or close an account are made by a person. We show you the reason in the app; you can ask us to review the decision by appealing in the app, or turn to the competent courts. The phone number of a suspended or closed account is kept in a one-way encrypted form to prevent the decision from being bypassed by opening a new account with the same number.
13.Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that location, map or other data will be accurate. Do not rely on Haritta for navigation, safety or emergency purposes. To the extent any warranty cannot be excluded by law, it is limited to the minimum permitted.
14.Limitation of liability
To the maximum extent permitted by law, Haritta and Radix Software LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty US dollars (USD 50). Nothing in these Terms limits liability that cannot be limited under applicable law.
15.Indemnification
You agree to indemnify and hold harmless Haritta and Radix Software LLC from claims, damages and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or of any law or third-party right.
16.Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Disputes will be subject to the courts located in Wyoming, unless mandatory law in your country of residence gives you the right to bring proceedings in your local courts. If you are a consumer, you keep the benefit of any mandatory protections of the law of your country of residence.
17.Changes to these terms
We may update these Terms from time to time. When we make material changes we will update the "Last updated" date and, where appropriate, notify you in the app. Your continued use of the Service after an update means you accept the revised Terms.
